text-align: justify; text-indent: 2em; line-height: 1.75em;"><span style="text-indent: 0em; letter-spacing: 1px;">为严厉打击非法种植罂粟等毒品原植物违法犯罪行为，进一步强化我市禁种铲毒工作，净化社会环境，根据《中华人民共和国刑法》《中华人民共和国禁毒法》《中华人民共和国治安管理处罚法》以及《福建省禁毒条例》等有关规定，特通告如下：</span></section></section><section style="text-align: justify; margin: 0px; text-indent: 2em; line-height: 1.75em;"><span style="color: #ffffff; font-size: 17px; text-decoration: none; letter-spacing: 1px;">一、严禁任何单位和个人非法种植罂粟、大麻等毒品原植物；严禁非法买卖、运输、携带、持有未经灭活的毒品原植物种子或者幼苗；严禁非法运输、买卖、储存、使用罂粟壳。</span></section><section style="text-align: justify; margin: 0px; text-indent: 2em; line-height: 1.75em;"><span style="color: #ffffff; font-size: 17px; text-decoration: none; letter-spacing: 1px;">二、严禁任何餐饮行业、食品生产经营者或个人在食品中添加罂粟壳、罂粟籽、罂粟苗等毒品原植物及其非法制品。</span></section><section style="text-align: justify; margin: 0px; text-indent: 2em; line-height: 1.75em;"><span style="color: #ffffff; font-size: 17px; text-decoration: none; letter-spacing: 1px;">三、凡主动铲除毒品原植物或主动上交非法持有的毒品原植物种子、幼苗以及罂粟壳的，可以依法从轻、减轻或者免于处罚。</span></section><section style="text-align: justify; margin: 0px; text-indent: 2em; line-height: 1.75em;"><span style="color: #ffffff; font-size: 17px; text-decoration: none; letter-spacing: 1px;">四、凡非法种植罂粟不满五百株且不主动铲除的，公安机关将依法予以拘留、罚款等行政处罚；非法种植罂粟五百株以上且不主动铲除的，将依法追究刑事责任；对非法种植的罂粟一律强制铲除。</span></section><section style="text-align: justify; margin: 0px; text-indent: 2em; line-height: 1.75em;"><span style="color: #ffffff; font-size: 17px; text-decoration: none; letter-spacing: 1px;">五、每个公民都有检举、揭发非法种植毒品原植物以及其他涉毒违法犯罪行为的义务。对于积极举报非法种植毒品原植物，举报非法买卖、运输、携带、持有未经灭活的毒品原植物种子或者幼苗，举报非法运输、买卖、储存、使用罂粟壳的，公安机关将按照《福建省毒品违法犯罪举报奖励办法》给予500元至5万元人民币奖励，并为举报人严格保密。</span></section><section style="text-align: justify; margin: 0px; text-indent: 2em; line-height: 1.75em;"><span style="color: #ffffff; font-size: 17px; text-decoration: none; letter-spacing: 1px;">六、各级人民政府应当定期组织公安、农业、林业等相关职能部门开展非法种植毒品原植物巡查踏查。乡镇人民政府、城市街道办事处应依法承担禁种铲毒的主体责任，发现非法种植毒品原植物的，应当立即采取措施予以制止、铲除，确保4月30日前彻底铲除干净。村民委员会、居民委员会发现非法种植毒品原植物的，应当及时予以制止、铲除，并向当地公安机关报告。</span></section><section style="text-align: justify; margin: 0px; text-indent: 2em; line-height: 1.75em;"><span style="color: #ffffff; font-size: 17px; text-decoration: none; letter-spacing: 1px;">七、凡有关乡镇（街道）未认真履行禁种铲毒职责，5月1日后被国家禁毒办或省禁毒办暗访踏查、无人机航测发现非法种植罂粟等毒品原植物达到重点整治标准的，市禁毒委将依据有关规定予以分级分类重点整治，依法依规追究相关责任人责任。</span></section><section style="outline: 0px; text-indent: 2em; line-height: 2em;"><span style="outline: 0px; font-size: 16px;">我国《刑法》规定，非法种植罂粟、大麻等毒品原植物的，一律强制铲除。</span></p><p style="outline: 0px; text-indent: 2em; line-height: 2em;"><span style="outline: 0px; font-size: 16px;"><strong style="outline: 0px;">有下列情形之一的，处五年以下有期徒刑、拘役或者管制，并处罚金：</strong></span></p><p style="outline: 0px; text-indent: 2em; line-height: 2em;"><span style="outline: 0px; font-size: 16px;">(一) 种植罂粟五百株以上不满三千株或者其他毒品原植物数量较大的；</span></p><p style="outline: 0px;
